Vendio Widgipedia Policy

These terms are incorporated by reference into Vendio's User Agreement at http://www.vendio.com/company/terms.html and are subject to such User Agreement. Your use of any of Vendio's services is subject to the User Agreement in its entirety.
Widgipedia is a service offered by Vendio Services, Inc. ("Vendio"). This policy refers to all of the information, code, programs, and anything else available from Widgipedia as "content". Where applicable, you may view and read the content of the website and make contributions by adding, deleting, or modifying content or software for this website ("Contributions").

1. Intellectual Property.

1.1 Owner.

Any software available through Widgipedia remains the property of the author or licensor. Vendio reserves the right to delete or modify the Contributions if the Contributions are inappropriate or for any other reason not compliant with the purpose of the website. Vendio may conduct such modifications or deletions without giving notice.

1.2 Trademarks.

Any of the trademarks, service marks, collective marks, design rights, personality rights or similar rights that are mentioned, used or cited in the content are the property of their respective owners. Unless otherwise stated, Widgipedia is neither endorsed nor affiliated with any of the holders of any such rights and as such Widgipedia can not grant any rights to use any otherwise protected materials. Your use of any such or similar incorporeal property is at your own risk.

2. Contributions

You may not upload, post, publish, reproduce, transmit or otherwise distribute any Contribution that:

a) constitutes or encourages conduct that would constitute a criminal offense or give rise to civil liability, or otherwise use the Widgipedia site in a manner which is contrary to law or would serve to restrict or inhibit any other user from using or enjoying the Widgipedia site or the Internet;

b) contains a virus, cancelbot, trojan horse, worm or other harmful or disruptive component;

c) is protected by copyright, or other intellectual property right, or derivative works with respect hereto, without obtaining permission of the copyright owner or rightholder;

d) reveals trade secrets or are obscene or defamatory or abusive or infringes other intellectual property rights

3. Monitoring

Vendio has no obligation to monitor the Widgipedia Site. However, you agree that Vendio has the right to monitor the Widgipedia Site electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate the Widgipedia Site properly, or to protect itself or its subscribers. Vendio will not intentionally monitor or disclose any private electronic-mail message unless required by law. Vendio reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this Agreement.

4. Jurisdiction and Legality of Content

Publication of content may be in violation of the laws of the country or jurisdiction from where you are viewing this information. Widgipedia does not encourage the violation of any laws; and cannot be responsible for any violations of such laws, should you link to this domain or use, reproduce, or republish the information contained herein.

5. Indemnification

You hereby agree to indemnify and hold Vendio harmless from any and all costs, losses, claims, damages, expenses, or liabilities, including legal expenses and expenses of enforcement suffered or incurred as a result of infringement of third party copyright or other intellectual property caused by the exercise and use of the Contributions or violation of any of these terms and conditions. You are not aware of any infringement of the Contributions of a third party or of any other intellectual property claims regarding the Contributions. You will assume the risk for all claims concerning infringements in relation to the Contributions.

6. Disclaimers

6.1 Vendio disclaims any responsibility for the deletion, the failure to store, the misdelivery, or the untimely delivery of any information or material on Widgipedia. We disclaim any responsibility for any harm resulting from downloading or accessing any information or material from Widgipedia. We disclaim any responsibility for any service outages that are caused by our maintenance on the servers or the technology that underlies our sites, failures of our service providers (including telecommunications, hosting, and power providers), computer viruses, natural disasters or other destruction or damage of our facilities, acts of nature, war, civil disturbance, or any other cause beyond our reasonable control.

6.2 Widgipedia is not reviewed; all content is provided without any implied warranty of fitness for any purpose or use whatsoever. Vendio is not in any way whatsoever responsible for the content for your use any of the content.

6.3 Widgipedia's content is distributed on an "as is, as available" basis. Any material that you download or otherwise obtain is done at your own discretion and risk, and you will be solely responsible for any potential damages to your computer system or loss of data that results from your download of any such material.

6.4 Neither we nor any of our partners makes any warranty that (i) our sites will meet your requirements, (ii) our sites will be uninterrupted, timely, secure, or error free, (iii) the results that may be obtained from the use of our sites will be accurate or reliable, (iv) the quality of any products, services, information, or other material that you purchase or obtain through our sites will meet your expectations, and (v) any errors will be corrected. Neither we nor any of our partners makes any warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose, with respect to our sites, any content, or any of our services, tools, products, or properties. You expressly agree that you will assume the entire risk as to the quality and the performance of our sites and the accuracy or completeness of its content.

6.5 Neither we nor our partners shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of or inability to use our sites, even if we have been advised of the possibility of such damages.

6.6 Some states do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such states, our liability and that of our third-party content providers and their respective agents shall be limited to the greatest extent permitted by law.
